| dc.description | Esta investigación está dirigida a demostrar que los Centros Penitenciarios y Carcelarios
en Colombia no garantizan los derechos fundamentales de las personas que se encuentran privadas
de la libertad. El enfoque principal será específicamente en relación con el derecho a la salud del
que gozan todas las personas, amparados por el artículo 49 de la Constitución Política de
Colombia. Para el caso específico, se analizará el Complejo Carcelario y Penitenciario
Metropolitano de Bogotá “COMEB - La Picota” como una de las más importantes y
representativas del territorio nacional.
Se analizarán aspectos estructurales del centro, capacidad de albergue, rasgos
administrativos, técnicos, logísticos e intervención del Estado en el manejo de normas de sanidad
y bioseguridad para el control y manejo de la reciente pandemia Covid – 19. Estos factores guiarán
la presente investigación de trabajo de grado hacia la ineluctable conclusión que las falencias
existentes en el Complejo Carcelario y Penitenciario Metropolitano de Bogotá “COMEB - La
Picota”, respecto a políticas públicas, son insuficientes para garantizar los derechos fundamentales
de las personas privadas de la libertad, específicamente el derecho a la salud | spa |
| dc.description.abstract | This investigation is aimed at demonstrating that prisons and prisons in Colombia do not
guarantee the fundamental rights of people who are deprived of liberty. The focus will be
specifically in relation to the right to health enjoyed by all people, protected by article 49 of the
Political Constitution of Colombia. For the specific case, the Metropolitan Prison and Penitentiary
Complex of Bogotá "COMEB - La Picota" will be analyzed as one of the most important and
representative of the national territory.
Structural aspects of the center, shelter capacity, administrative, technical, logistical
features and State intervention in the management of health and biosafety standards for the control
and management of the recent Covid-19 pandemic will be analyzed. These factors will guide the
present investigation of degree work towards the ineluctable conclusion that the existing
