dc.descriptionCultural heritage is given historical and cultural values ​​for a given nation. It must be considered that many of these goods are identity and memory of the history and culture of all mankind. The intentional and direct destruction of a cultural heritage in a given territory in time of war is a war crime and must be treated as such by humanitarian law. The article analyzes the case of Timbuktu, in which the destruction of cultural patrimony was considered a crime of war. A brief history on the protection of cultural heritage in times of war is presented, as well as current legislation, among them Resolution 2347 of the United Nations Security Council, the first resolution aimed only at the protection of cultural heritage in case of armed conflict. Finally, the first indictment of a war crime by the International Criminal Tribunal for the Direct Destruction of Cultural Heritage in Mali is addressed.en-US
dc.descriptionAl patrimonio cultural se les asignan valores históricos y culturales para una determinada nación. Debe considerarse que muchos de estos bienes son identidad y memoria de la historia y de la cultura de toda la humanidad. La destrucción intencional y directa de un patrimonio cultural en determinado territorio en tiempo de guerra es crimen de guerra y debe ser tratado como tal por el Derecho Humanitario. El artículo analiza el caso de Timbuktu, en el que la destrucción de patrimonio cultural fue considerada crimen de guerra. Se presenta, una breve historia sobre la protección del patrimonio cultural en tiempos de guerra, así como la normativa vigente, entre ellas, la Resolución 2347 del Consejo de Seguridad de las Naciones Unidas, siendo la primera resolución dirigida únicamente a la protección del patrimonio cultural en caso de conflicto armado. Por último, se aborda la primera condena de crimen de guerra por la Corte Penal Internacional de destrucción directa de patrimonio cultural, ocurrida en Malí.es-ES
